Can my landlord show my house while I still occupy the property?
me Asked: Can my landlord show my house while I still occupy the property?
I gave notice that I will be moving out at the end of the month. She now wants to show the property which I gave permission to do once thinking I would be allowed to be present and that it was just one client she was showing, but when she showed up, she asked me to leave the property, propped my front door open and held an open house for half an hour, letting prefect strangers have free reign of my house while I was not there. I feel very uncomfortable letting strangers in my house while I am home, let alone while I am gone.I have a large dog as well that is very friendly while I am around, but very protective of his property around strangers.I feel that I should be present at least to take care of my dog. She also posted the address on craigslist so now I literally have people stopping and looking in my windows at me.I work in an OR so I don't have access to my phone or email often, and when I get off work I have numerous texts, missed calls, and emails, wanting to show the house. One contact attempt would be sufficient. This is really getting to be annoying to me. She still has not rented the property and wants to have another open house. Is this normal?Should she wait until I move out? What can I do?
Answers:
I don't think they can force you to leave while they show people around, you pay to stay there so you don't have to leave. They are allowed to have people look around if you still live there. They must give 24 hours notice however You can't refuse because you do not own the place.
an open house and a specific one client showing are TWO DIFFERENT THINGS.
NO agent may do anything to the door….or bring in more than one tenant…….ONE tenant
[or tenant's family]–per each 24 hour notice.
Call the agent's broker……tell him-her that you want to file a complaint.
the posting on Craig's list is legal; the LL used poor judgment but it is not illegal.
under no circumstances would I tolerate an open house.YOU do not need to accept it.
refuse it.file a complaint with the state DEPT of RE.
She has every right to show her property. It does not matter if you are there or not.
